Marijuana Concentrate in Florida

Have you heard of “dabbing,” “vaping,” or “BHO?” These are the terms commonly used to describe THC concentrate consumption. THC or marijuana concentrates are becoming increasingly popular throughout the United States and especially on college campuses.

Tetrahydrocannabinol, also known as THC, is the main component of marijuana. THC is the ingredient that gives its user the “high” feeling. Marijuana concentrates contain potency levels that are significantly higher than the normal plant substance.

Unlike the green plant-based substance, THC concentrates consist of an oil or wax-like substance that is created by using a solvent like ethanol, CO2, or butane to extract the THC from the marijuana plant.

Given that, Florida law treats THC concentrate possession substantially more harshly than the plant counter-part. Any possession of THC concentrate, at all, is a felony in Florida.

Florida Law Regarding Marijuana Concentrates

In Florida, with the exception of a small amount of the plant-based substance, marijuana is still classified as a Schedule I substance. A Schedule I substances is a drug that has not been approved for medical use and has a high risk of abuse.

The emerging acceptance of marijuana for recreational and medicinal uses has created an interesting response to marijuana legalization across the country. While some states have completely legalized marijuana for recreational purposes, other states have simply chosen to make medical marijuana legal.

In Florida, marijuana is only legal to authorized users for medicinal purposes. The Florida law legalizing medical marijuana was passed in November 2016. The penalties for being caught with marijuana are as follows:

  • First-degree Misdemeanor – a person is guilty of a first-degree misdemeanor if he or she possesses twenty (20) grams or less of marijuana. First-degree misdemeanors are punishable by up to one (1) year in prison and up to $1,000 fines.
  • Third-degree Felony – A person commits a third-degree felony if he or she possesses between twenty grams and twenty-five pounds of marijuana or any amount of hash or concentrate.
